Agreement to Terms

By accessing or using Canonically (the "App") and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and Canonically ("we," "us," or "our"). We may modify these Terms at any time, and your continued use of the Service constitutes acceptance of any modifications.

Description of Service

Canonically is a language learning application that enables users to read foreign language literature while building vocabulary through spaced repetition. Our Service includes:

• Access to a library of public domain literary works in multiple languages
• Interactive reading features including word definitions and grammatical analysis
• Personalized vocabulary flashcards using spaced repetition algorithms
• Progress tracking and learning analytics
• Cloud synchronization across devices

Account Registration

To use certain features of the Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials and not share them with others
• Promptly update your information if it changes
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.

Subscription and Payments

Free and Premium Tiers

Canonically offers both free and premium subscription tiers. The free tier provides limited access to our library and features. Premium subscriptions unlock the full library, unlimited flashcard reviews, and additional features.

Billing

Premium subscriptions are billed through the Apple App Store or Google Play Store. By subscribing, you authorize recurring charges to your chosen payment method. Subscription fees are charged in advance on a monthly or annual basis, depending on your selected plan.

Cancellation and Refunds

You may cancel your subscription at any time through the App Store or Play Store settings. Cancellation takes effect at the end of your current billing period. We do not provide refunds for partial subscription periods, except as required by law or app store policies.

Price Changes

We reserve the right to change subscription prices. Any price changes will take effect at the start of your next billing period following notice of the change.

Intellectual Property

Our Content

The Service, including its design, features, software, and original content, is owned by Canonically and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

Public Domain Works

The literary works available in our library are in the public domain. While the original texts are not copyrighted, our annotations, translations, vocabulary data, and formatting are proprietary to Canonically.

Your Content

Any notes, highlights, or custom vocabulary you create within the App remain your property. By using the Service, you grant us a limited license to store and process this content to provide the Service.

Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers
• Use automated systems or software to extract data from the Service (scraping)
• Share your account credentials or allow others to access your account
• Circumvent any access controls or usage limits
• Transmit malware, viruses, or other harmful code
• Use the Service for any commercial purpose without our authorization

Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Educational Content

While we strive for accuracy in our vocabulary definitions, grammatical analyses, and translations, language is complex and context-dependent. Our content is intended for educational purposes and may contain errors. We do not guarantee specific learning outcomes.

Availability

We do not guarantee uninterrupted or error-free access to the Service. We may suspend or discontinue the Service or any features at any time without notice.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CANONICALLY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE PAST TWELVE MONTHS FOR THE SERVICE.

Indemnification

You agree to indemnify, defend, and hold harmless Canonically and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any third-party rights.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

• Your right to use the Service will immediately cease
• You may request a copy of your data before termination takes effect
• Provisions of these Terms that by their nature should survive termination will remain in effect

Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Canonically regarding your use of the Service and supersede any prior agreements.
